What counts as evidence of fair process before a dismissal
When a dismissal is challenged, the reason is often not the problem. The process is. Australian unfair
dismissal law asks whether the person was treated fairly: whether they knew there was an issue, were given a
chance to respond, and were given a chance to improve. The hard part for most employers isn’t doing
those things. It’s proving they did.
Fairness is a process, and a record
A valid reason isn’t enough on its own. The person has to have been told, clearly, that there was a
problem. They have to have had a real opportunity to respond and improve. And you have to be able to show all
of it happened. Process without a record is, in practice, no process at all.
What the record needs to show
- That the concern was raised, when, and how.
- That the person was given a chance to respond.
- That support and a chance to improve were offered.
- That the steps happened over time, not all at once at the end.
A dismissal that appears as a single event, with nothing before it, is the pattern that loses.
The timing problem
Records built after a decision to dismiss carry little weight, because they’re obviously a defence.
Records built as the situation unfolded carry a lot, because they’re obviously the truth. This is why
fair process can’t be reconstructed at the end. It has to be captured along the way.
Consistency matters too
Fairness also means treating like situations alike. If one person was managed one way and another
differently, that gap becomes the argument. A consistent record across leaders is part of what makes any
single case defensible.
